This Policy explains how MediFinder handles user-uploaded content (text, photos, videos, audio), the license you grant by uploading, how copyright owners can request removal of infringing content (DMCA, EU DSA, Turkish Law 5651), and the consequences of repeat infringement. By uploading content to MediFinder, you agree to this Policy and our Terms of Service.

1. Scope

This Policy applies to all User Content uploaded, posted, or transmitted through MediFinder, including:

  • Text posts, comments, reviews, and messages
  • Photos (profile photos, post photos, review photos, before/after photos)
  • Videos (procedure videos, testimonials, educational content, profile videos)
  • Audio recordings
  • Documents, PDFs, or other uploaded files
  • Live streaming content (where enabled)

2. Content You May Upload

  • Content you created entirely yourself
  • Content you have express written license to use for this purpose
  • Content in the public domain
  • Content covered by Creative Commons or similar licenses that permit the intended use
  • Content depicting only yourself, where you are the subject
  • Content depicting others only with their documented consent
  • Content depicting minors only with documented parental/guardian consent

3. Content You May NOT Upload

Without permission from the rights holder, you may NOT upload:

  • Copyrighted music, films, TV shows, or other media
  • Photographs or videos created by other people
  • Content that incorporates copyrighted material (e.g., background music in your video)
  • Trademarked logos or brand assets
  • Content scraped or copied from other websites or platforms
  • Patient images or videos without that patient's documented consent
  • Content depicting third parties without consent
  • Pirated or unauthorized derivative works
  • Content created by AI systems that infringes another party's rights

4. Your Representations and Warranties

By uploading any content, you represent and warrant that:

  • You own all rights to the content OR have obtained all necessary licenses, consents, and permissions
  • The content does not infringe any copyright, trademark, patent, trade secret, publicity right, privacy right, or other right of any third party
  • All persons identifiable in photos or videos have provided documented consent
  • Minors depicted have documented parental or legal guardian consent
  • Content was not obtained through unauthorized scraping or extraction from other platforms
  • The content complies with all applicable laws

5. License You Grant to MediFinder

By uploading User Content, you grant Yeshan Healthtech, LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, cache, reproduce, copy, modify, adapt, translate, create derivative works of, publish, transmit, distribute, publicly perform, publicly display, and otherwise exploit the User Content in connection with the operation, provision, promotion, marketing, and improvement of the Services.

This license includes the right to:

  • Host and display your content within the Services
  • Reformat, resize, and transcode (compress videos, generate thumbnails, etc.)
  • Translate into multiple languages
  • Cache and replicate for performance
  • Apply automated content moderation and analysis
  • Feature in marketing and promotional materials of the Services
  • Sublicense to service providers for the purposes above

You retain ownership of your content. The license continues for a commercially reasonable period after deletion to allow for the propagation of deletion across our systems and backups.

6. License Granted to Other Users

You grant each other user of the Services a worldwide, non-exclusive, royalty-free license to access your publicly-shared content through the Services and use it only as enabled by features of the Services (viewing, reacting, sharing within the platform). This license does not authorize others to use your content independently of the Services.

7. Use of Content for AI and Machine Learning

7.1. Internal AI Training

MediFinder may use de-identified and aggregated User Content to train, develop, evaluate, and improve internal artificial intelligence and machine learning models that power the Services.

7.2. No Identifiable Health Data for AI

MediFinder will not use your identifiable Health Data to train AI models without your specific consent.

7.3. Opt-Out Right

You may opt out of having your de-identified content used for AI training by emailing [email protected] with subject "AI Training Opt-Out".

7.4. No Third-Party AI Training

You may not use the Services or any content available through them to train any third-party AI or machine learning model without express prior written authorization from MediFinder. Unauthorized scraping for AI training is a material breach of our Terms.

8. Content Moderation

MEDIFINDER RESERVES THE RIGHT TO SCREEN, MONITOR, REVIEW, REMOVE, EDIT, RESTRICT, SUSPEND, OR REINSTATE ANY USER CONTENT AT OUR SOLE AND ABSOLUTE DISCRETION, FOR ANY REASON OR NO REASON, WITH OR WITHOUT NOTICE.

Content moderation includes automated systems (CSAM detection, malware scanning, copyright matching, spam detection) and human review. Decisions may be appealed by emailing [email protected] with subject "Appeal Request".

9. Copyright Infringement Notification (DMCA — United States)

MediFinder respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512(c). If you believe content on the Services infringes your copyright, you may submit a takedown notice.

9.1. Required Information

Your DMCA notice must include all of the following:

  • Your physical or electronic signature
  • Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works)
  • Identification of the material that is claimed to be infringing, with sufficient detail to permit us to locate it (URL or other specific reference)
  • Your name, address, telephone number, and email address
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf

9.2. How to Submit

9.3. False Notices

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees, incurred by the alleged infringer.

9.4. Counter-Notification

If your content was removed due to a DMCA notice and you believe it was removed in error, you may submit a counter-notification. Your counter-notice must include:

  • Your physical or electronic signature
  • Identification of the material that was removed and its location prior to removal
  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed by mistake or misidentification
  • Your name, address, and telephone number
  • A statement consenting to the jurisdiction of the federal court in the district where your address is located (or, for non-US users, the Southern District of Florida)
  • A statement that you will accept service of process from the person who provided the original DMCA notice

Submit counter-notices to: [email protected] with subject "DMCA Counter-Notice". If we receive a valid counter-notice, we may restore the content unless the original complainant files a court action within 10-14 business days.

10. EU Digital Services Act (DSA) — Notice and Action

EU users may submit notices about illegal content under DSA Article 16:

10.1. Required Information

  • A sufficiently substantiated explanation of why the content is illegal
  • Identification of the content (URL or specific location)
  • The name and email of the person submitting (unless the notice concerns content that may involve sexual offenses against minors, in which case anonymity is permitted)
  • A statement of good faith belief in the accuracy of the notice

10.2. How to Submit

10.3. Statement of Reasons

When MediFinder removes, demotes, or restricts content based on a DSA notice or our own moderation, affected users receive a Statement of Reasons consistent with DSA Article 17 (where applicable), including: the legal or contractual ground, the specific facts considered, the geographic scope of the action, the duration, and the available redress mechanisms.

11. Turkish Law No. 5651 — Content Removal

Türkiye'de ikamet eden kullanıcılar, 5651 sayılı Kanun kapsamında içerik kaldırma talepleri sunabilir:

11.1. Required Information

  • İçeriğin URL adresi veya yeri
  • Kişilik haklarına saldırı, suç teşkil eden içerik, özel hayatın gizliliğine ihlal vb. yasal dayanak
  • Başvuranın kimlik bilgileri ve iletişim bilgileri
  • İçeriğin neden kaldırılması gerektiğine dair açıklama

11.2. How to Submit

11.3. Response Time

5651 sayılı Kanun'un m.9 ve m.9/A hükümleri uyarınca, geçerli talepler 24 saat içinde değerlendirilir. Mahkeme kararı veya Bilgi Teknolojileri ve İletişim Kurumu kararı gerektiren talepler için ayrı prosedürler uygulanır.

12. Other Jurisdictions

For copyright or content removal requests from jurisdictions not covered above, contact [email protected] with subject "Legal Notice". We will evaluate the request under applicable law and our policies.

13. Right of Publicity and Image Rights

If your name, image, voice, likeness, or other identifying characteristic appears in User Content without your consent, you may request removal:

  • Email [email protected] with subject "Privacy Inquiry"
  • Identify the specific content (URL)
  • Confirm that you are the person depicted
  • State that you did not consent to the depiction or use

This applies particularly to before/after photos, testimonial videos, and other content where Providers or others may have depicted patients without proper consent.

14. Repeat Infringer Policy

14.1. Three-Strike Rule (Copyright)

  • Three valid copyright takedown notices within any 12-month period will result in account termination
  • Successful counter-notifications do not count as strikes
  • Bad-faith strikes (later determined to be fraudulent) do not count

14.2. Other Violations

Repeated violations of other content rules (CSAM, hate speech, harassment, etc.) result in immediate or escalating enforcement at our sole discretion, including permanent termination.

14.3. Circumvention

Terminated users may not create new accounts. Detection of circumvention results in immediate termination of the new account.

15. Storage Limits and Format Requirements

  • Maximum file sizes for photos, videos, and other media are displayed at the time of upload
  • Supported file formats may change over time
  • MediFinder may compress, transcode, or otherwise process uploaded media for storage and delivery efficiency
  • EXIF metadata may be stripped automatically to protect privacy
  • Excessive storage use may be limited at our discretion

16. Automated Content Scanning

Content uploaded to the Services is automatically scanned for:

  • Child sexual abuse material (CSAM) — reported to NCMEC and law enforcement as required by U.S. law
  • Malware, viruses, and harmful code
  • Spam and abuse patterns
  • Copyright matching against known content fingerprints
  • Policy violations (hate speech, harassment, prohibited categories)
  • Health misinformation patterns

By uploading content, you consent to such automated scanning. Automated removal decisions may be appealed.

17. Backups and Server Copies

When you delete content, copies may remain in our backup systems for up to 90 days before permanent deletion. These backup copies are not accessible through the Services and are retained solely for disaster recovery and legal compliance purposes.

Content shared by others (such as quoted in another user's post, or shared with their followers) may persist on the Services even after your deletion.

18. Limitation of Liability

MediFinder is not responsible for the content uploaded by users. We act as a host and benefit from intermediary-liability protections under Section 230 of the U.S. Communications Decency Act, the EU Digital Services Act, KVKK, Turkish Law No. 5651, and similar laws in other jurisdictions.

19. Indemnification

You agree to indemnify MediFinder against any claim arising from User Content you upload, including but not limited to: copyright infringement claims, defamation claims, privacy violations, right of publicity violations, and any third-party claims based on your content.

20. Changes to This Policy

  • Updates published at medifinder.com/content-policy
  • Material changes notified via email and in-platform notification
  • Continued use after publication constitutes acceptance
